2.1 Website

2.2 Platform and customer data
Platform data is hosted in the region corresponding to the customer's location.
France and the European Union
Data of European customers is hosted in the European Union, with Amazon Web Services (Paris region, with redundancy in Frankfurt) and Microsoft Azure (France Central region). These providers hold HDS certification (Hébergeur de Données de Santé, the French certification required for hosting personal health data), as required by article L. 1111-8 of the French Public Health Code.
United States
Data of U.S. customers is hosted in the United States. Vocca's hosting providers for this region are contractually bound as subcontractors under HIPAA, and Vocca enters into a Business Associate Agreement with each of them before any Protected Health Information is processed. There is no U.S. equivalent of HDS certification; compliance rests on the HIPAA Security Rule and on the contractual chain of Business Associate Agreements.
Certain corporate, support and engineering functions are carried out from France. This may involve access to U.S. customer data from outside the United States, under the safeguards described in the Privacy Policy.
3. Personal data protection
The processing of personal data is described in the Privacy Policy, available from the footer of the website. The roles and the applicable regime differ by jurisdiction.
France and the European Union
Processing is governed by the General Data Protection Regulation and the French Data Protection Act. Where Vocca processes data on behalf of a healthcare practice, it acts as a processor on that practice's documented instructions.
Vocca has appointed a data protection officer (DPO), registered with the CNIL, the French data protection authority, under number DPO-158853. Contact: dpo@vocca.com.
Data subjects have rights of access, rectification, erasure, restriction, objection and portability over their data, exercisable at that address. They may also lodge a complaint with the CNIL, at www.cnil.fr.
United States
Where Vocca creates, receives, maintains or transmits Protected Health Information on behalf of a healthcare provider, it acts as a Business Associate under the Health Insurance Portability and Accountability Act of 1996 ("HIPAA"), and the provider acts as the Covered Entity. A Business Associate Agreement is entered into before any PHI is processed.
HIPAA rights over PHI, access, amendment, and an accounting of disclosures, are exercised with the healthcare provider rather than with Vocca. Patients who contact Vocca directly are referred to their provider.
Residents of certain U.S. states have additional rights over personal data that is not PHI, including rights of access, correction and deletion, and the right to opt out of the sale or sharing of personal data. Vocca does not sell personal data. These requests may be addressed to dpo@vocca.com. The processing of personal data is described in the Privacy Policy, available from the footer of the website.

4. Terms of use
Use of the Vocca website and platform is subject to the Terms of Service, available from the footer of the website. For customers, the subscription agreement and the data processing agreement or Business Associate Agreement take precedence over the Terms of Service in the event of conflict.
5. Intellectual property
All elements making up the website, namely text, images, video, logos, graphics, layout, source code, databases, trademarks and domain names, are the exclusive property of Vocca or are licensed to it.
Any reproduction, representation, modification, publication, transmission or adaptation of all or part of these elements, by any means whatsoever and on any medium whatsoever, without Vocca's prior written authorization, is strictly prohibited.
The Vocca name and logo are the property of Vocca. Any unauthorized use constitutes infringement under French law and trademark infringement under U.S. law.
6. Liability
Vocca endeavors to publish accurate and up-to-date information on the website, without guaranteeing that it is complete or continuously current. Information published on the website is provided for information purposes only and constitutes neither medical advice nor a contractual commitment.
Vocca cannot be held liable for any direct or indirect damage arising from access to the website, its use, or the inability to access it.
The website may contain links to third-party sites. Vocca exercises no control over those sites and accepts no responsibility for their content.
Nothing in this notice limits Vocca's liability for gross negligence or willful misconduct, for personal injury, or in any case where the applicable law prohibits such limitation.
